Welcome to FreeImageGeneratorAI. These Terms of Service ("Terms") govern your access to and use of our free AI image generator at freeimagegeneratorai.com (the "Service"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required for consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

2. The Service

The Service lets you generate images from text prompts using AI models (currently FLUX.1 schnell via Replicate). We may modify, suspend, or discontinue any part of the Service at any time, and may limit the number of free generations per day to keep the Service sustainable.

3. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Generate content that infringes the intellectual property, privacy, or other rights of any person.
• Generate sexual content involving minors, or any content that exploits or harms minors.
• Generate content that promotes violence, terrorism, hatred, or self-harm.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to access, damage, overload, or reverse-engineer the Service, or use automated means to bypass usage limits.
• Use the Service to build a competing AI image product.

We may block content, throttle access, or suspend users who violate these rules.

4. User Prompts

You are solely responsible for the prompts you submit and the images generated from them. You grant us a limited, non-exclusive license to process your prompt solely to provide the Service to you.

5. AI-Generated Content & Ownership

Images are produced using FLUX.1 schnell, licensed under Apache 2.0. Subject to applicable law and these Terms, you may use the images you generate for personal and commercial purposes. You acknowledge that:

• AI-generated content may be imperfect, unexpected, or coincidentally similar to existing works.
• You are responsible for ensuring your use of generated images complies with applicable laws and does not infringe third-party rights.
• We do not guarantee exclusive rights to any generated image, and we are not liable for how generated images are used.

6. Paid Plans (Pro & Ultimate)

Paid plans, if and when introduced, will be subject to additional terms, including pricing, billing, and cancellation/refund policies displayed at checkout. Paid features and pricing may change over time. Free-tier users are never charged.

7. Third-Party Services & Links

The Service relies on third parties (e.g., Replicate, Cloudflare Turnstile, Google AdSense) and may contain links to third-party sites. We are not responsible for their practices, content, or availability.

8. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that generated images will meet your requirements.

9. Limitation of Liability

To the maximum extent permitted by law, FreeImageGeneratorAI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your generated content, or your violation of these Terms.

11. Term and Termination

These Terms are effective while you use the Service. We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive termination (e.g., ownership, disclaimers, liability limits) remain in effect.

12. Governing Law

These Terms are governed by the laws applicable at the operator's jurisdiction, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
